Southern Reporter 3d, Florida case law

The legal justice system is founded upon case law.  Florida case law appears in Thompson Reuter’s Southern Reporter.  Radha Rothrock’s appellate work has been published several times.  Enclosed are links to some of the results and publications of Rothrock Law Firm PL:

Radha Rothrock represented a father in an action in which the Department of Children and Families took the father’s child from him.  She tried the case and lost in front of the trial judge.  She appealed the decision to the Second District Court of Appeal, and the Department of Children and Families conceded error.  The appellate court reversed the decision.

Radha Rothrock was appointed to represent a father in a termination of parental rights proceeding in Gainesville.  She argued in the appeal that the state did not follow its procedural requirements.  The state conceded error and the decision was reversed.

The Court appointed Radha Rothrock to represent a mother whose rights had been terminated.  She argued in the appeal that the trial judge did not make its required findings of fact to terminate rights.  The state conceded error and the decision was reversed.

This was Carl and Radha Rothrock’s first collaborative effort as attorneys.  They represented two contractors in a breach of contract action in Texas.  They argued that their clients were entitled to punitive damages.  They won, and the defendant appealed.  The appellate case was one of first impression.  It defined procedural requirements concerning a defendant’s place of residence and also whether punitive damages could be awarded in a breach of contract case.  The court upheld the trial court’s decision, and The Rothrocks won the case.  This case has since been cited in Texas procedural treatises.

In this case, Radha Rothrock was appointed to represent a father who was incarcerated in North Carolina for 15 years.  The Court terminated his rights.  Rothrock argued that the court made no findings that termination was the least restrictive means of achieving permanency for the child.  The appellate court agreed and reversed the decision.

RESULTS

The members of Rothrock Law Firm PL are experienced bankruptcy, tax, and immigration attorneys in Fort Myers, Cape Coral, and Naples.  Listed below are some of the results that they have achieved for clients:

  • Successfully discharged over $20 million dollars of debt for real estate developer in Chapter 7 case.  Client was able to keep all assets and pay nothing to creditors.  Client obtained credit score of over 700 within 2 years of discharge.

    • Successfully discharged over $14 million dollars of debt for investor in Chapter 7 case.  Client was able to keep home and repay $14,000 to creditors to repay $14 million dollars of debt.
      • Successfully confirmed chapter 11 plan where client paid $5,500 to settle $500,000 of past due IRS debt.   Client was able to keep home and strip $500,000 second lien on home.
        • Successfully confirmed chapter 11 plan where client kept multiple investment properties for approximately $400,000 where total debt owed was $2.5 million.
          • Discharged over $100,000 of credit card debt in chapter 13 case and stripped second mortgage.  As a result, clients were able to reduce monthly expenses by $3,000 per month, modify mortgage, and save their home.
            • Bankruptcy trustee in chapter 13 case allowed client to contribute to cash value life insurance policy while in chapter 13 plan.   Usually, these contributions are not allowed; however, Rothrock Law Firm PL successfully showed extenuating circumstances.
              • Stopped IRS wage garnishment and placed client on uncollectible status with IRS.  Client had not filed tax returns in 5 years and owed approximately $30,000 of IRS debt.  Client’s garnishment was released within 3 days, and client did not have to make any payments.
                • Stopped IRS wage garnishment, filed 6 years of tax returns for client and put client on five year payment plan with IRS within one week.
                  • Successfully negotiated IRS settlement for client concerning delinquent payroll taxes.  Client owed approximately $73,000.00  in unpaid payroll taxes.  Stopped IRS levy and put client on payment plan of $125.00 per month.  Client was able to continue running his business
                  • Filed audit reconsideration and successfully reversed finding of more than $60,000.00 in trust fund penalties.
  • Appealed taxpayer’s case and IRS agreed to reverse $17,000 tax assessment against tax payer.
